5.2  Failed Payment Plan Instalments

Where a Participant's registration is cancelled due to failed installment payments (see Clause 3.3(c)), all amounts paid to date are non-refundable, irrespective of the time remaining before the Retreat.

5.3  Transfers & Name Changes

A confirmed registration may be transferred to another eligible individual, subject to the Organiser's prior written approval and payment of an administrative transfer fee of USD $150. Transfer requests must be submitted no later than 60 days before the Retreat start date. Transferred places are non-refundable to the new registered Participant.

The Organiser strongly recommends that all Participants purchase comprehensive travel insurance, including cover for trip cancellation, medical expenses, evacuation, and personal liability, prior to travel. The Organiser accepts no liability for costs arising from a Participant's failure to obtain adequate insurance.

6.  CANCELLATION OR MATERIAL ALTERATION BY THE ORGANISER

6.1  The Organiser reserves the right to cancel the Retreat if circumstances beyond its reasonable control make it impractical or impossible to deliver the Programme as designed. In such circumstances, the Organiser will notify Participants as promptly as reasonably possible.

6.2  In the event of an Organiser-initiated cancellation that is not attributable to a Force Majeure Event:

— Participants will receive an alternate event date  from We Are Creation which must take place within 18months of the original event date, otherwise the participant will receive a full refund of all amounts paid to the Organiser, within 30 business days of We Are Creation informing the participant that they will not provide an alternative event date; or

— At the Participant's election, a transferable credit of equivalent value applicable to a future We Are Creation event.

6.3  The Organiser's liability in the event of cancellation is strictly limited to the refund of the Retreat Investment received. The Organiser is not liable for any travel costs, visa fees, accommodation booked independently, or other consequential expenses.

6.4  Where the Organiser makes a material alteration to the Programme (such as a change of primary venue or a significant change to Programme dates), Participants will be notified and offered the option to accept the alteration or cancel with a full refund.

7.  FEATURED SPEAKER

7.1  Michael Bernard Beckwith participates in the Retreat as an independent educator. His engagement is subject to a separate agreement between the Organiser and his representatives.

7.2  In the event that Michael Bernard Beckwith is unable to attend due to illness, injury, circumstances beyond his reasonable control, or any other unforeseen circumstance, the Organiser will make reasonable efforts to provide an adjusted Programme and/or alternative facilitators selected by the Organiser.

Such circumstances shall not automatically entitle Participants to a refund, unless the Organiser determines that the overall Retreat experience has been materially affected.

7.3  Nothing in these Terms creates any direct legal relationship between the Participant and Michael Bernard Beckwith.

8.  PARTICIPANT RESPONSIBILITIES & CONDUCT

8.1  Participants are responsible for ensuring they hold a valid passport with a minimum of six months' validity beyond the Retreat end date, and for obtaining any visa or entry permit required for travel to Indonesia. The Organiser accepts no liability for denied boarding or entry.

8.2  Participants confirm they are in satisfactory physical and mental health to participate in the Programme. Participants are responsible for disclosing any medical conditions, mobility limitations, or other circumstances that may require accommodation, prior to the Retreat start date.

8.3  Participants agree to conduct themselves with respect, care, and consideration for all other Participants, facilitators, venue staff, and the wider community. The Organiser reserves the right to remove any Participant whose behaviour is disruptive, harmful, or inconsistent with the values of the Retreat, without refund.

8.4  The Retreat is designed as a deeply personal and transformational experience. Participants are requested to honour the confidentiality and privacy of fellow Participants and to refrain from sharing others' personal disclosures beyond the Retreat container.

8.5 The Retreat is intended for personal growth, education, spiritual development, and wellbeing. It is not medical treatment, psychotherapy, psychiatric care, counselling, or a substitute for professional healthcare.

Participants are responsible for consulting an appropriately qualified healthcare professional if they have any concerns regarding their physical, emotional, or mental ability to participate.

Participants remain responsible for their own wellbeing throughout the Retreat and are encouraged to participate in all activities at a level appropriate to their individual circumstances.

8.6 Shared Accommodation bookings acknowledge that room allocations are arranged by the Organiser. While reasonable efforts will be made to accommodate rooming preferences where possible, room assignments remain at the sole discretion of the Organiser.

8.7 Participants acknowledge that certain Retreat activities, including but not limited to yoga, movement sessions, meditation, outdoor experiences, and other experiential practices, involve inherent physical and emotional risks.

By participating, each Participant voluntarily assumes these risks and agrees to participate responsibly, within their own abilities and personal limits.

8.8 Participants are responsible for the safekeeping of their personal belongings throughout the Retreat.

The Organiser accepts no responsibility for loss, theft, or damage to personal property except where caused directly by the Organiser's negligence.

9.  INTELLECTUAL PROPERTY & RECORDING

9.1  All Programme content, materials, guided processes, methodologies, and frameworks shared during the Retreat — including without limitation Michael Bernard Beckwith's Life Visioning Process™ — are the proprietary intellectual property of their respective rights holders and are protected by applicable intellectual property laws.

9.2  Participants may not record (audio or video), photograph, reproduce, distribute, or commercialise any Programme content or teaching without the prior express written consent of the Organiser and/or the relevant rights holder.

9.3  The Organiser may capture photography and video content during the Retreat for archival, educational, promotional, and marketing purposes.

By registering, Participants grant the Organiser a non-exclusive, royalty-free, worldwide licence to use their image or likeness in such materials.

Participants who do not wish to appear in photographs or video recordings must notify the Organiser in writing before the Retreat begins.

The Organiser will make reasonable efforts to honour such requests; however, incidental inclusion in wide-angle photographs, group images, or event footage cannot always be avoided.

10.  LIMITATION OF LIABILITY

10.1  The Organiser's total aggregate liability to any Participant, whether arising in contract, tort, or otherwise, shall not exceed the total Retreat Investment paid by that Participant.

10.2  The Organiser is not liable for: (a) personal injury, illness, loss, or damage to personal property sustained during the Retreat unless caused by the Organiser's own negligence; (b) any costs incurred independently by the Participant, including flights, visas, or separately booked accommodation; (c) any indirect, consequential, or special loss; or (d) any act or omission of the venue, the Featured Speaker, or any third-party service provider.

10.3  Nothing in this Agreement limits or excludes liability that cannot be lawfully excluded, including liability for death or personal injury caused by negligence.

10.4 The Organiser reserves the right to make reasonable adjustments to the Retreat schedule, daily timetable, facilitators, activities, session order, or Programme content where operationally necessary or where such adjustments enhance the Participant experience.

Such changes shall not constitute a material alteration of the Retreat provided the overall nature and quality of the Programme remain substantially unchanged.

11.  FORCE MAJEURE

11.1  The Organiser is not in breach of this Agreement and will not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disaster, epidemic or pandemic, government restrictions or travel advisories, war, civil unrest, terrorism, industrial action, or the acts of any governmental or supranational authority ("Force Majeure Event").

11.2  In the event of a Force Majeure Event rendering the Retreat impossible to deliver, the Organiser will use reasonable endeavours to offer an alternative date or credit towards a future event. Where no suitable alternative can be agreed, refunds will be assessed on a good-faith basis having regard to unrecoverable costs already incurred.

12.  PRIVACY & DATA

12.1  The Organiser processes personal data provided at registration in accordance with applicable data protection legislation and its Privacy Policy, accessible at wearecreation.world. Personal data is used solely for the purposes of administering the Retreat and, where consented to, for marketing communications.

12.2  Participants may withdraw marketing consent at any time by contacting the Organiser at the email address below.

13.  GOVERNING LAW & DISPUTE RESOLUTION

13.1  This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law provisions.

13.2  The parties agree to first attempt to resolve any dispute arising out of or in connection with this Agreement through good-faith negotiation. If a dispute cannot be resolved within 30 days, it shall be referred to and finally resolved by arbitration administered in Hong Kong in accordance with the HKIAC Administered Arbitration Rules, with proceedings conducted in the English language.

14.  GENERAL PROVISIONS

14.1  Entire Agreement.  This Agreement constitutes the entire agreement between the parties with respect to the Retreat and supersedes all prior representations, understandings, and agreements.

14.2  Severability.  If any provision of this Agreement is found to be unlawful, void, or unenforceable, that provision shall be severed without affecting the validity of the remaining provisions.

14.3  Waiver.  A failure by the Organiser to exercise any right under this Agreement does not constitute a waiver of that right.

14.4  Amendments.  The Organiser reserves the right to update these Terms and Conditions. Participants will be notified of material changes. Continued participation following notification constitutes acceptance.
